Gazprom and CDC: Defending EU Law from Arbitration?

This presentation, given by Dr Filippo Fontanelli, takes its inspiration from two recent opinions by Advocates General to the EU courts: AG Wathelet on 8 December 2014 in Gazprom, Case C-536/13 and AG Jääskinen on 11 December 2014 in CDC, Case C-352/13).

These disputes raise fundamental issues regarding 1) the compatibility of arbitrators’ cross-border anti-suit injunctions with the Area of Freedom, Security and Justice and 2) the arbitrability of claims for damages based on Article 101 TFEU. The opinions struggle to examine the effect of arbitration on the integrity of EU law, and they open up systemic issues that the Court of Justice will have to address in its judgements. Dr Filippo Fontanelli is Lecturer in International Economic Law at the University of Edinburgh. He is also a member of the Centre for Judicial Cooperation at the European University Institute.
