Recent CJEU case law concerning EU citizens’ entitlement to social assistance benefits (Dano & Alimanovic), in which the Court decided to defer to the eligibility criteria laid down in the Citizenship Directive, is defended on two grounds. First, it is suggested that the use of legislation allows for a better regulation of the position of economically inactive EU citizens than the Court’s case-by-case process. More importantly, the Court made the right decision for reasons of process – that is, the democratic legitimacy of the law.
